What are btw and omzetbelasting?

In the Netherlands, btw and omzetbelasting are the Dutch terms used for value added tax, or VAT. A business charges VAT on taxable sales, while suppliers charge VAT on business purchases and expenses.

Input VAT that meets the conditions can be deducted from VAT due on sales. The resulting balance is paid to or reclaimed from the Netherlands Tax Administration. Sound VAT records show how each figure in the return was produced.

The correct Dutch VAT treatment depends on the specific supply and circumstances. A short list of examples cannot determine the final rate.

General rate

This rate applies where a supply is not subject to 9%, 0% or a VAT exemption.

Reduced rate

The reduced rate applies only to designated goods and services.

Zero rate

The zero rate applies in specific cases. The right to deduct input VAT may remain under the relevant conditions.

VAT-exempt supplies

No VAT is charged, while related input VAT is generally not deductible.

Which input VAT can be deducted?

Input VAT is VAT charged to your business by suppliers. It can usually be deducted where the costs are used for VAT-taxable activities and the invoice meets the applicable requirements.

Not all VAT is deductible. Mixed business and private use, VAT-exempt turnover, certain staff benefits and specific expenditure require additional attention. We therefore review both the accounting entry and the underlying use and documentation.

Return period

When is a Dutch VAT return due?

The Netherlands Tax Administration assigns the filing period. Most Netherlands-based businesses file quarterly, although monthly and annual returns also occur.

Monthly or quarterly

For Netherlands-based businesses, the return and payment are generally due by the final day of the following month.

Annual

An annual return is generally due before 1 April of the following year.

No turnover

If a return is available for the period but there is no turnover or VAT, a nil return will generally still be required.

Small businesses scheme

The KOR requires a business decision

The Dutch small businesses scheme, or KOR, is a VAT exemption for businesses that meet the conditions. The current Dutch turnover threshold is €20,000 per calendar year. Participants generally do not charge VAT, do not submit periodic VAT returns and cannot reclaim VAT on costs and investments.

Whether the KOR is suitable depends on investment plans, customer profile, expected growth and cross-border transactions. Exceptions and additional obligations can apply, so the choice should be reviewed before registration.

International transactions require additional analysis

The treatment depends on the transaction, where the parties are established, the customer’s status, the movement of goods and available evidence.

EU services and supplies

VAT identification numbers, place-of-supply rules, reverse charge and a possible ICP statement need to align.

Imports and exports

Customs documents, import VAT, proof of export and possible reverse-charge arrangements affect the records.

E-commerce and distance sales

Digital services, consumer sales and OSS can create additional VAT considerations.

Zero-rated or reverse-charged VAT does not apply automatically. We first determine which rules and reporting obligations may be relevant. Flicc Finance is not presented as your fiscal representative.

Correcting a VAT return

Correcting an earlier Dutch VAT return

The correct route depends on the amount, the return period and when the error is discovered.

Correction up to €1,000

Under the current rules, a correction of no more than €1,000 can be included in the next VAT return.

More than €1,000

A larger correction requires the Dutch supplementary VAT correction form, known as a suppletie.

Eight-week period

An error exceeding €1,000 must be corrected promptly and no later than eight weeks after discovery.

Earlier years

Corrections can generally be submitted up to five years after the year concerned.

Prompt voluntary correction can matter for interest and possible penalties. Rules can change; review the current guidance from the Netherlands Tax Administration

When is a supplementary VAT return required?

A Dutch suppletie is required for a VAT correction exceeding €1,000. The correction should be made promptly and no later than eight weeks after discovery. Always check current rules.

What should I do with foreign customers or suppliers?

Do I need an ICP statement as well as my VAT return?

An ICP statement may be required for certain supplies or services to business customers in other EU countries. It depends on the transaction and must reconcile with the VAT return.
